Abstract: 

On March 9, 2015, the U.S. Department of Justice filed its appellate brief and on April 8, 2015, Orrick, Herrington & Sutcliffe LLP filed its reply brief on behalf of Microsoft.  The case is a classic one for the court to apply a statute which was adopted at a time that the Internet was still in its infancy and the legal issues at stake were not contemplated.
