Abstract: 
On February 28, 2015, the United States Court of Military Commission Review (CMCR) overturned the decision of a Military Commission Judge and set aside the guilty plea of Australian, David M. Hicks to providing material support to terrorism, in violation of 10 U.S.C.§ 950v(b)25) (2006) and his sentence.  The appellate court, also in a decision by Deputy Chief Judge Silliman, in which Judge Weber concurred, found his waiver of his right to appellate review ineffective.
