Abstract:
On August 2, 1991, exactly one year after Iraq's invasion of Kuwait, the Governing Council of the United Nations Compensation Commission transmitted ground-breaking decisions to the members of the U.N. Security Council regarding the collection of claims against Iraq. The decisions established guidelines for the conduct of the Governing Council's work, criteria for expedited processing of urgent claims, and proposals on arrangements for ensuring payments to the Commission Fund. These U.N. decision represent a milestone in international law, establishing for the first time a postwar claims-settlement procedure with a built-in enforcement mechanism that is not based on the use of force.
