Abstract:
In several decisions regarding the Philippine judicial assiantce request in the Marcos Case, the Swiss Supreme Court in Lausanne gave its conditional approval to the repatriation of seized funds and to the delivery of bank records to the Republic of Philippines. The rulings have precedential value for other judicial assistance requests submitted to Swiss authorities. They prove the Swiss trend in bilateral judicial assistance developments to define strict and detailed lawful conditions in order to clarify the requirements of the Swiss law toward a country with fundamentally different legal and cultural traditions and special political circumstances.
