Abstract:
The Swiss Supreme Court decided on July 14, 1986 that some enforcement meaures for judicial assistance benefitting the United States are proper even if there is no proven violation of a criminal law in the requesting state. The fact that the alleged offense relates to U.S. commercial prohibitions of exporting high technology products does not imply that Switzerland can deny a judicial assistance request, the Court determined in this significant holding which underscores the liberal attitude of Switzerland in granting U.S. assistance requests.
