Abstract: 

On September 19, 2012, the Nevada Supreme Court reversed the judgment of the district court  which ruled that a convicted Mexican citizen on death row had the right to an evidentiary hearing on whether he had sustained actual prejudice to a constitutional right, due to lack of timely consular access.[1]
