Abstract: 
On May 29, 2007, the U.S. Court of Appeals for the Second Circuit upheld the decision denying Jose Cuevas, who was extradited from the Dominican Republic and was sentenced to 390 months of imprisonment, on his argument on specialty. Cuevas was originally indicted on September 29, 1998 along with none other defendants, for conspiring to distribute and to possess with intent to distribute five kilograms or more of cocaine from about 1995 through the date of the indictment.
