Abstract:
On January 9, 2003, the U.S. Supreme Court announced it had granted certiorari in the appeal of Yaser Esam Hamdi, an alleged Taliban fighter who U.S. forces arrested in Afghanistan in late 2001, and would decide whether the U.S. Constitution authorizes President Bush to order the indefinite detention of U.S. citizens captured abroad fighting for terrorist groups.
