Abstract:
Work on the principal conventions against transnational bribery, those of the OECD, the Organization of American States, and the Council of Europe, is continuing. Signatory countries are working to ensure proper implementation of the OECD Convention while the signatories of the Organization of American States and Council of Europe Conventions are working to have them take effect.
Signatories of the OECD Convention are reviewing whether implementing legislation fulfills the Convention’s requirements, especially with respect to corporate liability. The OECD Convention does not require corporate criminal liability. However, the penalties imposed through civil or administrative proceedings must be sufficient to be equivalent of criminal provisions or equally dissuasive.
