In a series of recent judgments handed down on June 20, 2012, the United Kingdom Supreme Court (UKSC) ruled on the interplay between Article 8 of the 1950 European Convention on Human Rights and Fundamental Freedoms (ECHR) and the law on extradition. Specifically, the Court was called upon to address the situation of a defendant’s children once the request for surrender has been submitted and is being considered by the requested state.
