Abstract:
At the Buenos Aires Conference on August 14-20, 1994, the International Committee of the International Law Association adopted a resolution on extradition and human rights. In addition to adopting recommendations on human rights considerations relevant to extradition and related procedures that are intended to guide action by responsible officials of government, the resolution invites the Committee to continue its work on the additional issues noted in the Report as ripe for further study by the Committee, including human rights implications of extradition procedures in the requested state, the exercise of jurisdiction by the requested state as an alternative to extradition, legal problems in the extradition of human rights law offenders, and legal problems related to the establishment of an international body to supervise extradition. The resolution recommends that the Committee conclude its work by drafting articles for a model multilateral treaty incorporating such human rights considerations as should, between the parties, override the obligations of bilateral extradition treaties that do not take adequate account of human rights considerations...(more)
